The law on silence in the Primorsky Territory of 2019 was somewhat modified and adjusted to the specifics of the region, taking into account the main provisions of federal law No. 52.

The preventive measures for actions that qualify as an administrative offense have become a little tougher, and the very qualification of illegal actions has also been modified. However, it is difficult to fully implement the updated law.

By and large, this is justified by the fact that most of the population of the Primorsky Territory has pets that regularly and unintentionally violate the law on silence in the Primorsky Territory.

In addition, these administrative violations have a rather short statute of limitations, which makes it difficult to timely report a violation and pay a fine in a timely manner.

Main provisions of the updated law

After amendments to the law on silence in the Primorsky Territory, the time limits were tightened, which restrict the performance of actions in apartment buildings and private households that exceed the permissible noise level.

On weekdays, this period is specified from 22:00 to 9:00 am, and from 23:00 to 10:00 am on holidays and weekends, as well as during daytime sleep from 13:00 to 15:00, on any and all the above days.

There are also objects, the list of which is provided for in the law on silence in the Primorsky Territory, which consists of:

  • individual residential apartments, common premises and property in common use by all who live in an apartment building, private household, hostel or communal apartment;
  • all types of adjacent territories, both individual and multi-apartment buildings, taking into account driveways, sidewalks, sports, children's or playgrounds, which are located inside the courtyard of an apartment building;
  • educational institutions, medical organizations and hospitals, organizations providing social and rehabilitation assistance to the population, sanatoriums and resorts, hotel complexes, as well as areas that are close to all of the listed types of organizations and institutions.

In addition, the law on silence in the Primorsky Territory describes in detail the actions that qualify as an administrative offense regarding the observance of silence and order during the period of time provided for at the legislative level. Illegal acts include:

  • sound reproduction on any audio, video or mechanical devices, which also includes various musical instruments, devices for amplifying sound, in particular in vehicles, which exceeds the permissible noise level in a specific period of time in accordance with the law of silence in Primorsky Krai;
  • it is forbidden to shout loudly, whistle, sing songs and sort things out in raised tones at night;
  • complete disregard for regularly triggered car alarms that violate public peace, regardless of the time frame provided for by the law on silence in the Primorsky Territory;
  • loading, unloading or moving furniture during the night when there are restrictions on noisy activities;
  • carrying out repair or construction work from 20:00 to 10:00 in the morning on any day of the week.

However, the law on silence in the Primorsky Territory provides for exceptional cases when the performance of actions exceeding the permissible noise level is allowed to be performed. These include:

  • performance of rescue operations and elimination of emergencies or consequences of accidents that have occurred;
  • festivities, sports competitions or religious ceremonies that are permitted by federal law;
  • it is allowed to exceed the noise level during the celebration of the new year from 22:00 pm on December 31st to 3:00 am on January 1st.
