Exceptions in the law
As in any law, there are exceptions here and they apply to such cases:
- carrying out rescue operations;
- elimination of emergencies and natural disasters, destruction, accidents.
Also, restrictions do not apply to garbage collection, snow removal. There are special instructions for New Year's Eve. On this beloved holiday, it is officially allowed to make noise from 22:00 to 3:00 and even use pyrotechnics. Another exception is May 1st. On this holiday, it is permissible to have fun from 21:00 to 24:00. It is impossible to punish under the law for holding public cultural, sports, religious and other official planned events of a city or federal scale.
How to file a complaint
Violators are brought to administrative responsibility and the authorities of the Nizhny Novgorod region order each of them to issue a fine in the prescribed amount. Any disagreements with neighbors or legal entities operating in the house or in its immediate vicinity must be resolved in civilized ways.
If the violator's own explanations are not enough, the police will have to be called. The district police officer will also conduct a warning conversation to begin with, but if the violations are systematic, then the culprit will not do without a fine. The most effective and quickly considered will be a collective complaint written by several residents of the entrance.
When the violator is a legal entity, and the noisy activities of his institution haunt the whole house, then you can contact Rospotrebnadzor. This organization is obliged to consider applications of citizens in which there is a complaint about the offense of legal entities. Thus, employees of Rospotrebnadzor can even go to the place to measure the noise. If the measurement shows that the permissible noise level is exceeded, then the complaint will be redirected to the appropriate organization, which has the authority to issue fines.
Complaining about your neighbor to this organization will be useless. First of all, of course, you should try to negotiate with your neighbor. If he makes repairs, you can simply specify the desired work schedule, so that it is convenient for both parties.
If noisy neighbors are tenants, then you can complain about them to the tax or migration service, but it is advisable to scare them with this first, perhaps this will be enough. For everyone, except for the owners of the apartment, they can apply an extreme measure for malicious non-compliance with the law on silence - eviction. If the apartment is owned, then such a measure is not applicable to its owner.
Legislation
According to the law, it is possible to make noise in apartment buildings on weekdays from 7:00 to 22:00, and on weekends and holidays – from 10:00 to 23:00. Quiet time is also provided for at the legislative level. It is slightly longer than in most regions and is 2.5 hours. Officially, this is the period from 12:30 to 15:00. This time is necessary for the normal rest of young children and the elderly. Separately, the ban applies to repair work, they can not be done on any day from 20:00 to 7:00. These laws will continue to apply in 2020.
Noise includes loud screaming, whistling, swearing, the rumble of moving furniture, creaking and banging, the operation of power tools, loud singing and playing musical instruments, the use of TV and other equipment at high volume, car alarms, barking dogs and other sounds that disturb public peace.
The ban applies not only to loud sounds, but also to vibrations that may be the result of repair work in a neighboring apartment or construction work if there is a construction site near the residential building.Both noise and vibrations negatively affect the body. Hearing, the nervous system, the cardiovascular system and even the immune system suffer from this. People, and especially children, become irritable, nervous, their efficiency, concentration, and memory decrease. Therefore, the requirement for silence is a necessity.
